Draft — review by counsel before public launch. This page describes our intended practices during the friends-and-family beta. Some mechanisms are still being finalized; bracketed items need decisions.

Terms of Service

Last updated: [DATE] · Status: Friends & Family Beta

1. Agreement

These Terms govern your use of Kiddemy's apps and website (the "Service"), operated by [LEGAL ENTITY NAME]. By creating an account or using the Service, you agree to these Terms. If you do not agree, please don't use the Service.

2. What Kiddemy is

Kiddemy provides math-learning apps for children in grades 1–4, a parent app for following a child's progress, and this website. The Service includes web and Android apps; an iOS version and a separate parental-controls app are planned but not yet available.

3. Who may use it; parental responsibility

The Service is intended for use by children under the supervision of a parent or legal guardian. Accounts are created and managed by a parent or guardian, who must be at least 18 years old and is responsible for setting up the child's app, supervising the child's use, and the activity under their family's accounts. By enrolling a child, you confirm you are that child's parent or legal guardian and consent to the data practices in our Privacy Policy.

4. Beta service — provided "as is"

Kiddemy is currently an early "friends and family" beta. It may contain bugs, may change significantly, and may be unavailable from time to time. The Service is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, and learning data may occasionally be lost or reset during the beta. Please don't rely on the Service as your only record of a child's progress.

5. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose;
  • attempt to gain unauthorized access to any part of the Service or other users' data;
  • interfere with or disrupt the Service or its infrastructure;
  • reverse-engineer or resell the Service except as allowed by law; or
  • share your account credentials with anyone outside your family.

6. Accounts and data

You are responsible for keeping your account credentials secure and for activity under your account. How we handle account and learning data — including parental consent and how to delete a child's data — is described in our Privacy Policy, which is part of these Terms.

7. Intellectual property

The Service, including its software, lessons, generated problems, text, graphics, and logos, is owned by [LEGAL ENTITY NAME] or its licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to use the Service for your family's own non-commercial learning. Common Core State Standards codes (e.g., "1.OA.A.1") are referenced as factual identifiers; Kiddemy is not affiliated with or endorsed by the standards' authors.

8. Changes to the Service and to these Terms

We may add, change, or remove features, and we may update these Terms. For material changes we'll post a notice in the Service or on this page and update the date above. Continued use after changes take effect means you accept the updated Terms.

9. Limitation of liability

To the fullest extent permitted by law, [LEGAL ENTITY NAME] will not be liable for any indirect, incidental, special, or consequential damages, or for lost data, arising from your use of the Service. Where liability cannot be excluded, it is limited to the amount you paid us for the Service (which, during the free beta, is zero).

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or end access to the Service, in whole or in part, including ending the beta.

11. Governing law

These Terms are governed by the laws of [GOVERNING-LAW JURISDICTION], without regard to its conflict-of-laws rules. Nothing here limits any rights that apply to you or your child under mandatory local law, including children's-privacy laws.
